AB 59 is a bill that clarifies existing revenue options for local school districts and is critical for Alameda Unified School District (AUSD) because of the parcel taxes that we have in place to support our public schools. The legality of Measure H (a parcel tax approved by Alameda voters in June 2008) is currently being challenged in the courts. Measure H is structured as a “split roll” tax, which means different rates are assessed for residential vs. commercial property owners. If the courts deem this taxing structure unlawful, AUSD may be required to refund up to $7.5 million to eligible property owners.

If passed, AB59 clarifies that split roll taxes are legal. The bill will apply retroactively to parcel taxes already in place, including Measure H, ensuring AUSD is able to keep existing funds. The Board of Education approved a formal resolution supporting AB59 and the Alameda PTA Council is also urging all PTA units and individuals to send a letter supporting the bill to Assemblymember Rob Bonta.
